Regulations and General Terms of Service
Wroclaw by Bike

Whenever the name Wroclaw by Bike appears in these terms and conditions, it means the company Von Quints MICE Sp. z .o.o., Ks. Witolda 49/15, 50-202 Wroclaw, NIP 898 220 30 09, Regon 022098648, KRS 0001080010.

 

1 Services

The conclusion of a contract for the provision of services in the form of a guided bicycle tour shall be binding when the Customer confirms his reservation and Wroclaw by Bike confirms the reservation or the Customer’s order. The contract referred to in the preceding sentence shall be implemented based on the provisions of these Regulations and applicable provisions of Polish law, and in accordance with publicly announced terms and conditions, such as on the Wroclaw by Bike website or in information leaflets. Additional arrangements beyond the regular contractual services require written confirmation by Wroclaw by Bike.

 

2 City tours

Strict adherence to the planned route or sequence of the tour program cannot be guaranteed. Wroclaw by Bike reserves the right to change the route or content of the tour in case of obstacles such as road works, street blockages or other unforeseen circumstances. In such a case, the participants of the bike tour will be informed immediately. Each tour guide has the right to adjust the route according to current conditions. Tours are held regardless of the weather, as long as it does not threaten the safety of participants. In the event that it becomes impossible to perform the primary service due to weather conditions, Wroclaw by Bike will provide participants with a proposal for a substitute service of an equivalent nature to the primary service, or a different type of substitute service. The Participant’s consent to the performance of the substitute service will be expressed by his/her participation in the proposed substitute service, and in such case the Participant waives any claims against Wroclaw by Bike.

3 Cancellations and reservations

Customers may cancel tours free of charge up to 14 days before the scheduled date. After this period, the following customer cancellation fees apply :
– 50% of the fee up to 7 days before the date,
– 75% of the fee up to 2 days before the date,
– 90% of the fee if cancelled less than 48 hours before the service,
– 100% of the fee if the customer does not show up.

The aforementioned cancellation fees will be deducted from the amount paid by the customer at the time of booking.

Special rules in case of bad weather:
In case of light rain, we will provide you with a cape to protect you from drops. In case of very heavy rain or thunderstorms just before the start of the tour, we will wait up to 30 minutes for conditions to improve. If bad weather catches us during the tour, we will try to find a safe and dry place where we can wait for the weather to improve. Note – we do not cancel tours due to weather, except in extreme situations (i.e. heavy rain, thunderstorm). In such a situation, if the tour was interrupted due to the above during the tour, we will refund 50% of the tour cost.

 

4 Safety

Participation in excursions is at your own risk. Participants are required to obey traffic regulations. Wroclaw by Bike is not responsible for damages or injuries caused by intentional, unintentional or negligent behavior of participants. Each participant assesses for himself/herself whether he/she is able to safely participate in the tour.

The participant declares that:
– he/she will not be under the influence of alcohol, intoxicants, psychotropic substances or drugs affecting mental and physical capacity during the use of the bicycle equipment,
– in his/her reasonable opinion he/she has sufficient technical skills to ride a bicycle safely,
– he/she has the knowledge of traffic regulations necessary to participate in the bicycle tour and, if applicable, the appropriate authorizations specified in the relevant laws to ride a bicycle in public traffic on the territory of Poland.

The participant shall bear full financial responsibility for any damage, destruction or loss of the bicycle equipment entrusted to him through his fault, including as a result of improper use, gross negligence or violation of the terms and conditions.

For possible damages to the bicycle equipment, Wroclaw by Bike reserves the right to block the amount of 800 PLN on the Participant’s credit card no later than the day of the bicycle tour as a security deposit. In case the blocking on the credit card referred to in the preceding sentence is not possible through the fault of the Participant, Wroclaw by Bike has the right to refuse the Participant’s participation in the bicycle tour and charge a cancellation fee in accordance with the provisions of Â§ 3 of these Regulations.

The deposit will be released immediately after the completion of the bicycle tour and inspection of the technical condition of the rented equipment, provided there is no observed damage or other claims by Wroclaw by Bike.

In the event that the amount of damage exceeds the value of the blocked deposit, the Participant agrees to immediately cover the difference between the value of the damage and the amount of the deposit, no later than the day of the end of the bicycle tour.

 

5 Limitation of liability

  1. Wroclaw by Bike will exercise due diligence in preparing and checking the technical efficiency of the bicycle equipment before the start of the tour.
  2. The participant is required to independently check, in accordance with the instructions given by the guide, the basic functions of the bicycle entrusted to him (in particular: brakes, steering, tires, drive, lights and bell) before the start of the tour and immediately report to the guide any irregularities found.
  3. This obligation also applies during the tour – the participant is obliged to report to the guide any technical problems or equipment malfunctions noticed as soon as they are discovered.
  4. Failure by the Participant to report any noticed malfunctions of the bicycle before or during the tour releases Wroclaw by Bike from liability for any damage that may have been caused by unreported technical defects.

 

6 Complaints

In case of problems, participants can request assistance by informing the guide or by calling the phone number provided: +48 786 973 890. If the customer does not make a complaint, his claims may be partially or completely invalidated.

 

7 Cancellations by Wroclaw by Bike

Wroclaw by Bike has the right to immediately cancel the participation of a person in the tour, in case of his persistent disruption of the tour despite previous warnings or disobedience of the guide’s safety instructions. Fees are then not refunded. Additional costs resulting from the interruption of the tour shall be paid by the disruptive person. Notwithstanding the above, Wroclaw by Bike has the right to cancel a reservation before the start of the service for any reason. In the case of a cause attributable to Wroclaw by Bike, the Participant shall be entitled to a refund of the full price immediately, but no later than within 7 days. In the case of a cause beyond the control of the Parties including force majeure, Wroclaw by Bike will offer the Participant a voucher for a bicycle tour to be used within 1 year. If the Participant refuses within 7 days of receiving the said offer, Wroclaw by Bike will refund the amount of the price to the Participant. In addition to the benefits specified above, Wroclaw by Bike shall not be obliged to provide any other benefits to the Participant as well as to cover any other costs or repair any damage incurred as a result of or in connection with the cancellation of the reservation by Wroclaw by Bike.

 

8 Data protection

All personal data of customers are processed electronically only for the purpose of contract and customer service. Wroclaw by Bike complies with the Personal Data Protection Act.

 

9 Renting bicycles and accessories

  1. Wroclaw by Bike also provides electric bicycle rental services under separately agreed conditions. The availability of this service and the details of its provision can be established at the headquarters of Wroclaw by Bike or by e-mail at: [email protected] Wroclaw by bike guarantees that the rented equipment is in good working order. The customer, by signing the contract, confirms the good condition of the equipment. Presentation of an identity document is required. The condition of renting the equipment is the blocking of funds on the Renter’s credit card security deposit equivalent to PLN 2,000.00. Wroclaw by Bike may retain the security deposit if the bike is damaged or not returned. This does not release the customer from liability for any damage incurred in excess of the value of the security deposit.
  2. The rental fee must be paid when signing the contract or booking online. The current price list applies.
  3. The extension must be agreed before the end of the original period. Otherwise, suspected theft is reported to the police after 24 hours.

 

10 Minimum age

The minimum age to rent a bicycle is 12 years old and a minimum height of 160 cm. Minors can only rent a bicycle under the supervision of an adult, who takes full responsibility for the minor and the equipment they rent.

 

11 Use of equipment

In the case of renting equipment, the customer confirms that he is familiar with traffic regulations and will obey them. Without written permission, it is forbidden:
– to ride on unpaved roads,
– to participate in competitions,
– to further rent the bicycle to third parties.

During both bike tours and rental services, equipment must be secured against theft (e.g., pinned to a rack or lamp post). In case of theft, the customer must immediately notify Wroclaw by Bike and the police. The customer is fully responsible for covering the loss.

 

12 Customer responsibility

The customer must return the equipment in the condition in which he rented it. The cost of repairing any defects and damage or theft is covered 100% by the customer. Repairs are carried out only by Wroclaw by Bike – the customer cannot repair the equipment himself.

 

13 Accidents

In the event of an accident, the customer is required to call the police (emergency number 112) and obtain a case number. This data should be immediately provided to Wroclaw by Bike.

 

14 Final provisions

Contracts entered into with Wroclaw by Bike shall be governed by Polish law. The place of performance and jurisdiction of the court is Wroclaw. If any provision proves to be ineffective, the others shall remain in force.
