Terms and General Conditions of Service
Wroclaw by Bike
01.07.2025
Whenever the name Wroclaw by Bike appears in these terms and conditions, it refers to the company Von Quints MICE Sp. z o.o., Ks. Witolda Street 49/15, 50-202 Wroclaw, NIP 898 220 30 09, Regon 022098648, KRS 0001080010.
§ 1 Services
A contract for the provision of services in the form of a guided bicycle tour becomes binding when the client confirms their booking and Wroclaw by Bike confirms the client’s booking or order. The agreement referred to in the previous sentence will be executed based on the provisions of these terms and conditions, the applicable provisions of Polish law, and publicly announced terms, e.g., on the Wroclaw by Bike website or in informational brochures. Any arrangements exceeding the regular contractual services require written confirmation from Wroclaw by Bike.
§ 2 City tours
Strict adherence to the planned route or the order of the tour program cannot be guaranteed. Wroclaw by Bike reserves the right to modify the route or tour content in case of obstacles such as roadworks, street closures, or other unforeseen circumstances. In such cases, bicycle tour participants will be informed immediately. Each tour guide has the right to adjust the route according to the current conditions. Tours take place regardless of the weather, unless it poses a safety risk to participants. If the original service cannot be performed due to weather conditions, Wroclaw by Bike will offer participants a substitute service of equivalent value or a different type of substitute service. Consent to the substitute service will be expressed by the participant’s participation in the proposed service, and in such case, the participant waives any claims against Wroclaw by Bike.
§ 3 Cancellation and reservations
Clients may cancel tours free of charge up to 14 days before the scheduled date. After this period, the following cancellation fees apply:
-
50% of the fee for cancellations up to 7 days before the scheduled date,
-
75% of the fee for cancellations up to 2 days before the scheduled date,
-
90% of the fee for cancellations less than 48 hours before the service,
-
100% of the fee for no-shows.
The above cancellation fees will be deducted from the amount paid by the client when making the reservation.
Special weather rules:
In case of light rain, we will provide you with a rain poncho. In the event of heavy rain or thunderstorms just before the start of the tour, we will wait up to 30 minutes for conditions to improve. If bad weather catches us during the tour, we will try to find a safe, dry place to wait for better conditions. Note: we do not cancel tours due to weather except in extreme situations (e.g., downpours, thunderstorms). If the tour is interrupted due to such conditions during its course, we will refund you 50% of the tour cost.
§ 4 Safety
Participation in the tours is at the participant’s own risk. Participants are required to follow traffic regulations. Wroclaw by Bike is not liable for damages or injuries caused by the intentional, unintentional, or negligent behavior of participants. Each participant must assess whether they are capable of safely participating in the tour.
The participant declares that:
-
they will not use the bicycle equipment under the influence of alcohol, drugs, psychoactive substances, or medications affecting psychomotor abilities;
-
in their reasonable judgment, they have sufficient technical skills to safely ride a bicycle;
-
they possess knowledge of traffic regulations necessary for participating in a bicycle tour and, if applicable, the required licenses under Polish law for riding a bicycle in public traffic.
The participant bears full financial responsibility for any damage, destruction, or loss of the entrusted bicycle equipment resulting from their fault, including improper use, gross negligence, or violation of the terms of these regulations.
As security for possible damage to the bicycle equipment, Wroclaw by Bike reserves the right to block an amount of PLN 800 on the participant’s credit card at the latest on the day of the tour. If it is impossible to block this amount due to the participant’s fault, Wroclaw by Bike may refuse the participant’s participation in the bicycle tour and charge a cancellation fee in accordance with § 3 of these Terms. The security deposit will be released immediately after the end of the tour and inspection of the rented equipment, provided no damage or other claims from Wroclaw by Bike are found.
If the amount of damage exceeds the blocked deposit, the participant agrees to immediately cover the difference between the damage amount and the deposit, no later than on the day the tour ends.
§ 5 Limitation of liability
-
Wroclaw by Bike will exercise due diligence in preparing and checking the technical condition of the bicycle equipment before the tour starts.
-
The participant is obliged to check, following the guide’s instructions, the basic functions of the entrusted bicycle (in particular: brakes, steering system, tires, drivetrain, lights, and bell) before the tour starts and immediately report any irregularities to the guide.
-
This obligation also applies during the tour – the participant must report any noticed technical problems or defects to the guide immediately after they are detected.
-
Failure to report observed irregularities in the bicycle’s operation before or during the tour releases Wroclaw by Bike from liability for any damages resulting from such unreported defects.
§ 6 Complaints
In case of problems, participants may request assistance by informing the guide or calling the provided phone number: +48 786 973 890. If the client does not report a complaint, their claims may be partially or completely invalidated.
§ 7 Cancellation by Wroclaw by Bike
Wroclaw by Bike has the right to immediately cancel a person’s participation in the tour if they persistently disrupt the tour despite prior warnings or fail to follow the guide’s safety instructions. Fees will not be refunded in such cases. Any additional costs resulting from the interruption of the tour will be borne by the disruptive person. Regardless of the above, Wroclaw by Bike has the right to cancel a reservation before the start of the service for any reason. If the reason lies with Wroclaw by Bike, the participant is entitled to a full refund immediately, but no later than within 7 days. If the reason is beyond the parties’ control, including force majeure, Wroclaw by Bike will offer the participant a voucher for a bicycle tour valid for 1 year. If the participant refuses this offer within 7 days of receiving it, Wroclaw by Bike will refund the price paid. Beyond the obligations described above, Wroclaw by Bike is not required to provide any other compensation to the participant or cover any other costs or damages resulting from or related to the canceled reservation.
§ 8 Data protection
All personal data of clients is processed electronically solely for the purposes of the agreement and customer service. Wroclaw by Bike complies with the Personal Data Protection Act.
§ 9 Bicycle and accessories rental
-
Wroclaw by Bike also provides electric bicycle rental services under separately agreed conditions. Availability and details of this service can be determined at the Wroclaw by Bike office or via email at [email protected]. Wroclaw by Bike guarantees that the rented equipment is in good condition. By signing the agreement, the client confirms the good condition of the equipment. An identity document is required. A condition for renting equipment is blocking a security deposit on the renter’s credit card in the amount of PLN 2,000. Wroclaw by Bike may retain the deposit in case of damage or failure to return the bicycle. This does not release the client from responsibility for damages exceeding the value of the security deposit.
-
The rental fee must be paid upon signing the agreement or making an online reservation. The current price list applies.
-
Extensions must be agreed upon before the original rental period ends; otherwise, after 24 hours, a theft report will be filed with the police.
§ 10 Minimum age
The minimum age for renting a bicycle is 12 years and a minimum height of 160 cm. Minors may only rent a bicycle under the supervision of an adult, who bears full responsibility for the minor and the rented equipment.
§ 11 Use of equipment
When renting equipment, the client confirms that they know and will follow traffic regulations. Without written consent, it is forbidden to:
-
ride on unpaved roads,
-
participate in races,
-
sublet the bicycle to third parties.
During both guided tours and equipment rentals, the equipment must be secured against theft (e.g., locked to a bike stand or pole). In case of theft, the client must immediately notify Wroclaw by Bike and the police. The client bears full responsibility for covering any losses.
§ 12 Client’s liability
The client must return the equipment in the condition in which it was rented. The client covers 100% of the repair costs for any damages or theft. Repairs are carried out only by Wroclaw by Bike; the client may not repair the equipment themselves.
§ 13 Accidents
In case of an accident, the client must call the police (emergency number 112) and obtain a case number. This information must be immediately provided to Wroclaw by Bike.
§ 14 Final provisions
Contracts concluded with Wroclaw by Bike are governed by Polish law. The place of performance and jurisdiction is Wrocław. If any provision proves ineffective, the remaining provisions remain valid.
